Humanitarian and Compassionate Applications

This application is for persons in Canada who would suffer excessive hardship if they had to return to their home country to apply for permanent residence in Canada as required by the Immigration and Refugee Protection Act. Cost and inconvenience are not considered excessive hardship.

Under section 25 of the act the minister has the authority to grant permanent residence or exemption from requirements in the act or regulations on humanitarian and compassionate or public policy grounds.

The applicant must satisfy the minister’s delegate that applying outside of Canada through the normal process would create hardship which is:

(i) Unusual and undeserved


(ii) Disproportionate

Applicants may present whatever facts they believe are relevant.
